Our Service will then access the content of the provided URL and use it to generate a new, summarized, or transformed article (the "Generated Content"). This Generated Content is stored privately and can be shared by you via a unique, private link.

2. User Accounts

  • Responsibility: You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.

3. User Responsibilities and Conduct

You are solely responsible for your conduct and the URLs you submit to the Service. By using the Service, you agree that you will not:

  • Violate Third-Party Rights: Provide any URL to a website for which you do not have the legal right, license, or permission to access and process its content. This includes respecting the terms of service, copyright notices, and robots.txt files of the third-party website.

  • Generated Content:

    • Ownership & Responsibility: The copyright of the Generated Content is complex, as it is a derivative work of the Third-Party Content. You acknowledge that any rights you have in the Generated Content are limited by the rights of the original owner of the Third-Party Content. You are solely responsible for ensuring your use of the Generated Content (including sharing it) complies with applicable copyright law (e.g., "Fair Use" or "Fair Dealing") and the terms of the original content source.
    • License to You: We grant you a limited, non-exclusive, non-transferable license to use, reproduce, and share the Generated Content for your personal or internal business purposes, subject to the limitations outlined in these Terms.
    • Your Responsibility for Sharing: When you share Generated Content via a private link, you are responsible for the act of distribution and for any consequences of that sharing.

  • Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EZLISTING, OR ANY OF OUR AGENTS OR CONTRACTORS, BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

9. Indemnification

You agree to defend, indemnify, and hold harmless EZListing, and any of our agents or contractors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms, including your representations regarding third-party content rights; (iii) your violation of any third-party right, including any right of privacy or intellectual property rights; (iv) any claim that your actions involving the Service caused damage to a third party.
